stumbled on the fix; not a start8 problem. since update1 "show windows apps on taskbar" being set is what causes this behavior.

both are 8.1. surface v1 was 8.0 and upgraded to 8.1; surface v3 comes with 8.1. neither boot to desktop mode, they boot to modern UI. open metro IE, swipe down metro IE and i'm in desktop mode.

switching from a surface 1 to a surface 3...both machines have 1.41 installed and I've gone through the settings to make sure they match. on the new computer when I swipe down to close a metro app such as IE, it closes it to the desktop mode instead of leaving it in metro.
