Huston, I think we have a problem!!!!!

Huston, I think we have a problem!!!!!

Jafo, I think we ALL have a problem!

I have just been informed that there is a company with the name Delphi-VCL Skin that sales the “Skin Engine” and with their product the give a huge number of skins, which means that the buyers of SkinEngine, can use those skins for having a profit with their business.

Here comes the good part of it!
The skins that they sell are all the works of known authors of WinCustomize, like Alexandrie, treetog, Mike Bryant, Grayhaze, essorant and many others.
There are no names, no credits, nothing, just an ID number of the skin.

Any one can download the skins for free, but the professionals can use them for their applications, sites etc and the have the right for the profit they will get, because the have purchase the Skin Engine!!!!!

I think this is too heavy to accept it.

I hope that our Official Layer Jafo will take care of it.

So, here something to start with Paul.

The following skin ID numbers are my skins:

0330
0294
0394
0379
0392
0177
0178
0034
0138
0377
0378
0060
0383
0353
0165
0249
0051
0203
0147
0075
0067
0030
0107

They don't have all the parts of the skin jebland, that is why are small, are in binary format and also are the latest skins

I sent them an email asking if they are open to discussing compensation for all the artists whose work they are using illegally. I wonder if they'll reply?

They even ripped one of my 2 (yes, count 'em) 2 windowblinds skins. First time ever being ripped. I e-mailed them.

That is great David I don't think that they care

Oh I'm sure they don't. Works from all the great ones are in there. It's just so frustrating that there doesn't seem to be a really good way of dealing with these folks. I guess, even if my skin wasn't there, I still take this personally. Wincusto and all you folks are sort of like a second home (isn't that pathetic ) and it just pisses me off that someone can steal from my home like this and get away with it.

mm, actually it could be hard coded into the products and then the skins have a key generated and imbeded into an obscure file that has to match the compiling SS editor, even if you add your key with a text editor for those cutting skins with those and run the skin against SS before posting. WB could then cross reference against the registration number used to register the products online to ensure the owner is running the product and the product is registed to make use of the skin/theme... or maybe not, just thinking with my fingers...

probably just opened myself up to 50 rants and such for even thinking it let alone openly mentioning it

send an email to their ISP... the people that host their site and have them taken off... send them links to specific skins here... and mention about theft... and copyright... but I know you guys have more classy terms... but get them taken off line... think like micrsoft would... WWMD??? microsoft would have them taken off the net... and have a big microsoft graphic put up... instead of their site..

OK...don't nuke anyone.

I emailed them yet again, but we need someone who can argue the case in Russian.
Their usual excuse is probably half real...no speakie de eengleesh.

Last time, I tried an online translator...however I believe I quite accurately explained to them their hovercraft was full of jellied eels.

Like I said, it is going to be a language issue.

But nuking, spamming...hate mail, etc is not the way to go about it...

Earlier today I had sent this email:

>Are you aware that the skins you are selling on your website are the copyrighted property of several artists? These skins are posted on several "skinning" websites and are owned by their creators. You have no permission to modify, redistribute or sell these copyrighted designs.
>
>Are you open to discussing compensation and credit for the artists whose work you are using?

And just got this reply:

David Knott

If their host/provider can have their site pulled for theft and/or piracy then that'll be a 'start'...

Mine, as usual....

It appears that you are displaying numerous skins on your site originally created by authors other than yourself.
Although images are freely available for download on the Internet, they are EXPRESSLY for personal use, which does not include the reproduction and redistribution of them via another site such as yours.
The modification, and/or re-distribution of an artist's images without his/her express permission is in violation of the Artist's Copyright, and is pursuable in law.

Whether these images link to the original artist's site or not, or whether the Original artist is credited or not, without prior permission to display such, you are in violation of inherent and/or expressed copyright.

I strongly suggest you remove any such images for which you do not have permission to display via verification of aurthor, and minimize the potential for litigation against you and subsequent claims for loss.

I await your favourable response.

I don't think that is very easy to deal with these guys and this bothers me a lot.
But we must not give up, I hope that every one from our community will help for the protection of authors rights!
