Well..apparently comments made upon a certain artists WB has caused rash decisions to be made, it is unfortunate.

I can see his point, the accusations were serious from an artistic point of view, I can see the "Accusors" point of view as well, tho I wonder, could this have been handled through Email, clearing up what I believe is simple coincidence? instead of publically accusing someone of something as serious as plagerism? ::sighs::

I do not know what the answers are, and I am not here to argue anybodies point..I simply would like to say it is too bad that these events have led to the loss of someone that is clearly as talented as the artisit is that has been accused and has left WC..
I hope it isnt perhaps to late for something to be worked out, but I am sure it is, both sides of the accusations are pretty steadfast in their actions and convictions..who really suffers? That would be the people now deprived of enjoying the work in question that is now no longer available to them..WC doesnt suffer..in Jafo's words.."It is your loss" and perhaps thats true..somewhat..but not completely..WC has lost something as well..but it is those that would have enjoyed the skin for what it is that have truly lost..over what?..a difference of opinion? Serious accusations made before finding out the exact truth?..

I dont know guys, I just think there must be a better way to handle incidents like this in the future..
And to the artist is question..you will be missed..
To the artists that felt plagerized.. I do still enjoy your works as well, if they were copied..that would not change.

The reason I need it so bad is so I can finally have active/inactive windows, and needed 6 states for the "add to border", and "cut from border" buttons. As I stated in my DA journal DZ you're a true friend. Jafo, and Treetog, are true gentlemen, and awesome skinners.
Once again, thank you all for your earnest support. Also It's good to see that someone aside from me digs Big G as much as I do.
I remember watching him, and the other Kaiju on channel 56 (massachussetts) every Sat. on a show called Creature Double Feature. The days when innocents was still abound, and preconceptions didn't exist....lol

???? You mean there was actually a controversial post that my name wasn't in? OMG call the National Weather Bureau coz Hell just froze over. I must be losing my touch or not paying attention enough but oh well... glad whatever happened is all sorted out and we can all go back to making blinds and stuff. However, on that note I do have a question. If you take a small image such as the X, square and - on a titlebar from someone else's blind and recolor it in your own photoshop are you stealing? Just want to ask because I was thinking of making a blind but want to be 100% original.

It's stealing if you plan to share it. You can do what you please for personal use only....... but think about what you said. It can't be 100% original, if you borrow images.

OK that's it! *looks for dull rusty razor blade* I'm gonna cry! All I want is an animated titlebar. That's all I ask for, but nooooooo, not for me, God hates me!....lol j/k. I am however in need of some assistance. I'm working on my new skin, and trying to animate the titlebar, but it isn't showing, in the skintest or the actual wb. the image is 16 frames from top to bottom, I have it set to dynamic, (disabled it to see if it would help) but nothing seems to work. Not even in the code. I figured I'd see something similar to the soundenabled=1, but nadda. I even did the same to the B,L,and R, thinking it would help. I know when I was working on my AL start menu the contents margin would screw up the animations if they were set a certain way but that's not the case either. If someone could please help me it would be greatly appreciated, until then I guess I'll work on some of the other elements. Thank you.

I don't know about that line of reasoning - after all PLENTY of companies revese engineer another compaines product, change one thing, and then get a patent for it and no one claims foul ball.

Ya know..Kona has a point..and as far as the "X" button itself..I have witnessed it being the same button that came with windows only skinned..is this not doing exactly what Angel is asking? if she doesnt actually use the "Titlebar" that perhaps is a unique creation..using the button shouldnt be an issue..but even so..Title bars are pretty basic..as far as the foundation of them..Rounded, squared..really the only true difference is the "clothes" it's wearing..She could probably use the entire thing and re-dress it and call it hers..

Unless the "X" button was turned into a very unique graffic that you could honestly say is a creation of a certain artist (as some of them are indeed) I cannot see the harm of changing the appearance of basically a standard button..
I may be wrong..I am no skinner ..yet..::laughs:: one day I will grow up to become one..LoL
But apparently it does happen all the time..

to answer a few questions...

if you take an other artists image and alter it and redistibute it .. your redistributing anothers altered works.. "theres issues with copywrites" ...also the degree of the altering comes in to play .....example ..** i take wallpaper XX from here at 1024x768 open it in paint . and blank it out then draw a whole new wall from scratch and upload it as wallpaper ZZ. im essentially redistributeing anothers "file" .. but the art work is all my own... usually no one complains abt this as the finished product looks nothing like the original...when the image is only slightly altered but still resembles the original.. then normally it will be considered a rip...

if you build an image "from scratch" to resemble anothers work you are emulateing anothers style/works.. emulation is more accepted as long as the works have an "inspired by" addition to the credits .. i mean its only fair.. if you use anothers design style to build something. you should let every one know who inspired you .. not only does it give the inspireing author due credit .. but makes you look more honorable to say "hey this person inspired me and they deserve credit"...

as for buttons and bars... there is only so many ways to draw an X .. no one will complain that you drew an X .. what will get peeps mad .. is if they drew that X, you take it recolor it green or something and upload it as your own creation...to draw such basic elements is the norm as most skins require these things .. but there is a differance between drawing an X and uploading it .. and useing some one elses X and uploading it ..

Why don't they win in court? Simply. Because the product the other company made based on their product has a few different parts - therefore it's considered a different product. I see no difference in skin making. After all - are they not all loosely based on Microsoft's Luna? All we did is change a few things from Luna and called it our own.

When I was a kid I loved Transformers. One day I went into a small store called Co-op, which sold mostly farm equip, and hardware, I saw some knockoffs of afew of the transformers I wanted. I still wouldn't buy them because they were too shabily made, and could be recognized as complete knockoffs. Sometimes a company will do this in order to sell a similar product abit cheaper than the original. Such was not the case in this point. They were actually a couple of dollars more! The point here is that advertising is a multi-million dollar industry, and most times they will latch onto a product that is popular and try to ride the cash cow into the ground with it. Go to your local area flea market and you'll see glaring examples of this. If you see a pair of Oakley sunglasses at a flea market for $8, you can bet your ass they ain't real! Especially since a legit pair is often into the hundred dollar range. As far as the courts go, copyright specs dictate that if you can change the product you are attempting to sell in at least areas, you can sell it without litigational reprocution,(if I remeber right). I think this is a very bad idea, and further more, said cos. are trying to make a buck on someone elses ideas, and hard work. Imitation is the afterbirth of innovation. (geez, I hope I don't fit into that!) YUK!

Bit of a generalisation....some have their nostrils slit for thieving.

Each case is heard onits own merit.

And anyway....when it comes to copyright rather than patent right it's entirely different, and a baseless argument...
