Question about using a copyrighted character in a skin.

Ummm a question regarding making your skins legal.
So say i want to add the character Squall from final fantasy.
Do i just add skin or do i have to put something in the skin info saying
"Squall is copyrighted material of square enix blah blah blah"

are you adding your own created from scratch graphic?

If you are using the art of someone else in your skin, you have to get that person's permission in writing and then include it with your skin's file.  You must also include a comment in the descrption whose art it is, and that permission.txt is included.

yepper... if using another's need permission.. if done from scratch.. can fall under fan art

Everytime this comes up, I get confused on the entire issue.

What about all of the DC MArvel hero windowblinds where DC and Marvel artists works were used..including copyrighted trademarks like Superman's S and the Green Lantern logo?

How does fair use and fan art apply to them? I know it probably has something to do with altering the images format...I think. So shouldn't that apply to vidoe game characters as well?

on trademarks I think it kinda depends on if the holder complains... like using windows/xp/vista/etc logos on stuff

A lot is stuff is called xp this vista that

I think if you create your own graphic for it, it's closer to fan art

I don't think fan art should include cut and paste or 'modified' graphics from another source without permission from that source

 

Jafo had a good explanation of it a while back (more than once, but I think it was from last year I'm remembering) but I can't find it
