Isn't the Windows Logo a Microsoft trademark? This page mentions: http://www.microsoft.com/en-us/news/ImageGallery/logos/logoguidelines.aspx third parties should not ship the Windows Logo with their product (which is used for the Start8 orb).

The Windows 8 'flag' graphic is not included with Start8 by design.

On the Windows 7 / XP graphics, Microsoft have not shown any concern over the mass use of those graphics in skins over the past decade so it seems likely they do not mind.  Should they have a concern I am sure we would accomodate their wishes.
