EULA for Fences 1.01.143

Quick question about the EULA for Fences version 1.01.143.  

Am I allowed to install this on a corporate machine without purchasing a license?  This release had a paid for and standard version.  If you wanted the additional features (which I did not) you needed to purchase a license.  Here is the EULA that came with my version (for those who may still have it installed it is located here by default: C:\Program Files\Stardock\Fence\eula.txt).  This EULA says nothing about installation for corporate/enterprise machines.  Are these EULAs version specific?  I need to know which one is correct so I can find out if installing the unpaid version (1.01.143) is acceptable on my work machine without first purchasing a license.

 

My EULA states the following:

 

YOU MAY:

1. Install and use one copy of the
SOFTWARE on a single computer.
2. Install a second copy of the SOFTWARE on a
second computer only if you are the main user of
this computer (home computer or laptop for
example).
3. Install the SOFTWARE on another computer only
if you change your main workstation. In such a case
you must uninstall the software from the old
computer.
4. Use the SOFTWARE via a network, only if you
have purchased an adequate number of licenses.
The number of users must not exceed the number of
licenses you have purchased.
5. Make a copy of the SOFTWARE for archival
purposes only.

YOU MAY NOT:
1. Copy and distribute the SOFTWARE
or any portion of it except as expressly provided
in this Agreement.
2. Sublicense, rent, lease or transfer your
personal registering number.
3. Sublicense, rent or lease the SOFTWARE or any
portion of it.
4. Decompile, disassemble, reverse engineer or
modify the SOFTWARE or any portion of it, or make
any attempt to bypass, unlock, or disable any
protective or initialization system on the
SOFTWARE.
5. Copy the documentation accompanying the
SOFTWARE.
6. Upload or transmit the SOFTWARE, or any
portion thereof, to any electronic bulletin
board, network, or other type of multi-use
computer system regardless of purpose.
7. Include the SOFTWARE in any commercial
products intended for manufacture, distribution,
or sale.

hmm...good question.    Can they define NON-PERSONAL use?   If my employer doesn't give me the tools I need and I buy them myself, and share them with no one, then is that not for my personal use? 

 

Also, this could just standard verbiage, as some software (icon making comes to mind) creates a product that is distributable.  Fences does not create a product that is distributed, just used on the computer it was installed on and usually by one user.  The exception would maybe be if one terminal or station is routinely used by many different people during the course of a day.  I let my wife or kids use my PC once in a while, I don't consider that breaking the EULA.

I would not consider using this in a work environment as indicated breaking the EULA, but Stardock may think otherwise. :rolleyes:

Hey Broderp - Thanks for the reply.  I totally agree, the language is a little ambiguous (probably on purpose).  I just went ahead and bought the license so I wouldn't have to worry about it, they definitely deserve my $7 as I use this everyday.  I am still curious though what Stardock's intention was with both of the EULAs and if they are version specific.  Hopefully a moderator stumbles on this.  Again, I appreciate your reply/thoughts.

I believe the free version cannot be used for corporate use and a paid version would need to be purchased to use it in that environment.

Who uses the free version?  Correct me if I'm wrong, but isn't the free version just a DEMO?  I have two separate paid licenses for Fences and am about to get a third.  (Maybe ^_^ , if my wife like the Demo I installed on her PC.) It's almost unusable with the nag screen after the trial period has ended.

 

Or did I pay for something I didn't need to.... o_O

There is no longer a free version. Just the 30 day trial. The former free version is not permitted for use in a corporate environment.

OK so the new EULA actually applies to all software versions, regardless of the EULA that was originally accepted with version 1.01.143, or any other version for that matter?

I believe Fences has had two main versions.  Version 1 and Version 2.  Currently Fences is on Version 2.  When I first installed the app it was on Version 1 (back in 2010) and I only used the most basic feature of putting folders\icons into a fence on my desktop, I didn't need any other functionality.  With Version 1 you got this basic functionality in a "Free" (non-Pro) version, there was no 30 day trial, it was just "Free."  Fast forward to today, I found out there was a newer version because my admin was saying I needed to upgrade to the paid version, version 2, or I would have to uninstall the application altogether.  They even sent me the current EULA which I thought was for version 2 only.  I tried saying that since I had version 1 that I agreed to the EULA that came with my version which made no mention of NOT being able to use it in a corporate environment.  That's when I came here to ask.  So since then I became a paying customer and updated to version 2.  Kind of a long story but I hope that makes sense.
